In this petition for writ of mandamus, the State seeks a declaration from this court that K.S.A. 1997 Supp. 22-3428(1)(a) mandates that a criminal defendant who has been acquitted on the basis of a mental defect or disease under K.S.A. 22-3221 be committed to the Larned State Security Hospital for safekeeping and treatment. The State asks this court to direct the Honorable Steven R. Becker to commit the defendant, David Proctor, under the provisions of 22-3428(1)(a).
